저당권과 관련된 민법의 개정

초록

This research proposes the revision of the text on hypothec. A lot of influences of a Japanese law remain in Korean security, especially in hypothec law. Korean civil law makes the Japanese Meiji civil law foundation in fact. Therefore, there is no substantial change in the civil law after early Meiji era and it has been arriving now. The necessity of the revision of the hypothec is instituted. At this time, the revision of a related civil law of Japan will become a reference valuable as for the revision of Korean civil law. Then, this research proposes the revision of the text on hypothec in civil law chiefly referring to a Japanese civil law.
